General Terms and Conditions of Sale – E-commerce

ARTICLE 1: SCOPE OF APPLICATION

These General Terms and Conditions of Sale apply to all sales concluded through the www.rockonwall.com website between a user of the site, hereinafter referred to as the Customer, and the company KPDP, a limited liability company with a capital of 20,000 euros, whose registered office is located at 42 rue Pré Didier – 38120 Fontanil Cornillon and registered with the Trade and Companies Register under number 489 034 348, hereinafter referred to as Rockonwall.com.

Placing an order implies the Customer's full and unreserved acceptance of these General Terms and Conditions of Sale. No agreement or commitment can, unless formally and in writing accepted by KPDP, prevail over these General Terms and Conditions of Sale. Any contrary clause set forth by the Customer will therefore, in the absence of express acceptance, be unenforceable against Rockonwall.com, regardless of when it may have been brought to its attention.

ARTICLE 2: ORDERS

Only online orders are taken into account.
Once the order is received and processed, a confirmation email with the package tracking number is sent to the Customer.
Rockonwall.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order.

ARTICLE 3: PRICES

Prices are indicated in euros and include all taxes in the country of departure, excluding shipping costs. They may be subject to change. Ordered items are invoiced based on the price in effect at the time the order is registered.
The price is payable in full and in a single installment upon order. All orders are invoiced in euros and payable in euros. For any delivery outside France, any customs duties or local taxes remain the responsibility of the recipient.

ARTICLE 4: SHIPPING COSTS

Shipping costs include a flat-rate contribution to processing and shipping costs. They are the responsibility of the Customer and are invoiced at the end of the order in addition to the selected products. They are valid in the European Community. For any other destination, the amount of shipping costs must be agreed upon prior to the order.

ARTICLE 5: PAYMENT

The Customer can pay for their order:
– by credit card

ARTICLE 6: ORDER PREPARATION

Orders are generally prepared within 48 hours of receipt of payment. This period may be longer during periods of high activity or school holidays. Rockonwall.com makes every effort to reduce this delay as much as possible. In case of preparation delay, an email will be sent to the Customer. In this case, and as long as the order has not been shipped, the Customer may cancel their order, which will be fully refunded.

ARTICLE 7: DELIVERY TIMES

Delivery is made by Colissimo within 48 hours from the date of deposit at the post office (delivery time in working days for shipments in mainland France, subject to meeting the cut-off time for deposit), to the delivery address indicated on the order, in France or in any country of the European Community.
Rockonwall.com cannot be held responsible for consequences due to a delay in delivery.
In case of delivery delay, the order having been shipped, the Customer may cancel it and request a refund as well as a refund of return costs (within the limit of the cost of standard shipping). Rockonwall.com will proceed with the refund after receipt and inspection of the products.

ARTICLE 8: RIGHT OF RETURN

The Customer has a period of 14 clear days from the delivery of the order to return their items to Rockonwall.com. The order will, at the Customer's choice, be exchanged or fully refunded within a maximum of 14 days, provided that the products are intact, show no signs of use, and are in their original packaging. The Customer can return their order to KPDP Customer Service – – 42 rue Pré Didier – 38120 Fontanil Cornillon. Return shipping costs are at the Customer's expense.
In case of return of an unclaimed package, refused package, or due to an incorrect address provided by the customer, one of the following options will be taken, according to your choice:
– either a refund of the order, minus the incurred shipping costs and a flat rate of 10 euros for handling fees
– or re-shipment of the order after payment of the additional shipping costs incurred.

ARTICLE 9: TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

The transfer of ownership of the products to the Customer will only take place after full payment of the price by the latter, regardless of the delivery date of said products. However, the transfer of risks of loss and deterioration of the products will take place upon receipt of said products by the Customer.

ARTICLE 10: INTELLECTUAL PROPERTY

All text data, photos, comments, works, illustrations and images reproduced on the website www.rockonwall.com are its property. Consequently, it is strictly forbidden to reproduce, download, copy, or exploit them, even partially, for commercial purposes anywhere in the world without prior agreement from Rock On Wall.

ARTICLE 11: LIABILITY

The products offered comply with current French legislation.
Rockonwall.com disclaims all responsibility if the delivered item does not comply with the legislation of the country of delivery.
Rockonwall.com disclaims all responsibility in case of non-performance of the contract due to force majeure (strike, flood, fire…).

ARTICLE 12: APPLICABLE LAW

All clauses appearing in these General Terms and Conditions of Sale, as well as all purchase and sale operations referred to therein, shall be subject to French law.
